IMAGE USAGE, BTS & EXCLUSIVITY POLICY
(Mandatory – Binding – Integral Part of This Quotation)
IMPORTANT – DECISION FRAMEWORK
AJN PRODUCTION follows a documentary and immersive approach to wedding photography and videography.
Our work goes beyond delivering final photos and films to our clients; it also relies on presenting authentic weddings, real working conditions and behind-the-scenes moments across our professional platforms.
By confirming a booking with AJN PRODUCTION, the client automatically grants the right to use selected photos, videos and behind-the-scenes (BTS) content for professional and promotional purposes.
This right is included by default in all our packages and pricing.
If the client does not wish to allow any publication, an Exclusivity & Confidentiality Fee will apply.
The Exclusivity Fee is set at 30% of the total package price.
If the client refuses the Exclusivity Fee, the quotation will be immediately cancelled and the booking request declined.
In such a case, AJN PRODUCTION reserves the right to terminate all discussions and refuse the collaboration, without justification.
Proceeding with the reservation confirms full understanding and acceptance of this policy.
Summary of the Policy
Image and BTS usage is standard, automatic and non-optional unless exclusivity is purchased.
All published content will be respectful, flattering and carefully curated.
No content will ever be used in a way that harms the client’s privacy, dignity or image.
Exclusivity is treated as a premium service, not as a default condition.
No individual approval or post-event request for non-publication will be accepted.
This visibility:
1- allows future clients to understand our workflow and professionalism,
2- builds trust through transparency,
3- sustains the continuity and development of our business.
As such, the right to use selected images, videos and BTS is a fundamental component of our service model and pricing structure.
It is not an additional request, but an inherent condition of collaboration.
Scope and Limits of Image Usage
Any content shared by AJN PRODUCTION will always:
1- be selected at our sole editorial discretion,
2- highlight positive emotions, elegance, celebration and atmosphere,
2- respect cultural, personal and emotional boundaries,
3- exclude any sensitive, compromising or private situations.
Usage is strictly limited to:
1- professional portfolios,
2- social media platforms,
3- promotional materials related to AJN PRODUCTION.
No content will ever be sold, licensed to third parties, or used outside this professional scope.
Exclusivity & Confidentiality Option
We understand that certain clients may require full discretion for personal, professional or cultural reasons.
This request is legitimate; however, it requires a substantial adjustment to our communication strategy and represents a direct loss of marketing value.
For this reason, we offer an Exclusivity & Confidentiality Option, which includes:
1- total non-publication of photos, videos and BTS,
2- exclusion from all AJN PRODUCTION platforms,
3- no use in portfolios, reels, teasers or promotional materials.
Exclusivity Fee
The Exclusivity Option is subject to an additional fee equivalent to:
30% of the total package price
(Example: for a package at 40,500, the exclusivity fee amounts to 12,150)
This fee reflects:
1- the exclusivity granted to the client,
2- the limitation imposed on our marketing and communication,
3- the structural impact on our business model.
Mandatory Conditions & Non-Negotiable Terms
Any request for exclusivity must be clearly stated before confirmation and payment.
Once a booking is confirmed without the Exclusivity Option, no request for non-publication will be accepted later.
Requests made after the event, after delivery, or after publication will be automatically declined.
AJN PRODUCTION reserves the right to refuse any booking where exclusivity conditions are incompatible with our operating model.
Final Acknowledgment
By confirming this quotation through the reservation with a monetary deposit , the client acknowledges and agrees that:
1- image and BTS usage is a default condition of service,
2- exclusivity is optional and paid,
3- AJN PRODUCTION retains full editorial discretion,
4- no additional consent will be requested before publication.
Legal Basis & Applicable Law (Mauritius)
This Image Usage and Exclusivity Policy is established and enforced in accordance with the laws of the Republic of Mauritius, including but not limited to:
Copyright & Intellectual Property
Pursuant to the Copyright Act 2014 (Mauritius), the Photographer/Videographer remains the author and original owner of all intellectual property rights attached to the photographs and video recordings created during wedding and event coverage, unless otherwise expressly agreed in writing.
In particular:
The Photographer holds the exclusive economic rights to reproduce, publish, distribute, communicate to the public, and otherwise exploit the visual content created (Copyright Act 2014, Sections 6 and 9).
The Photographer retains moral rights, including the right to authorship credit and the right to object to any distortion or misuse of the work that may prejudice professional reputation (Section 7).
Any assignment of rights or grant of exclusivity must be expressly agreed in writing, clearly defining scope, duration, territory, and purpose, in accordance with Section 12 of the Copyright Act 2014.
Unless such written agreement exists, the delivery of images or videos to the Client constitutes a limited licence for personal use only, as defined in the service agreement.
Image Usage, Consent & Data Protection
In accordance with the Data Protection Act 2017 (Mauritius), photographs and video recordings in which individuals are identifiable may constitute personal data.
By engaging the Photographer’s services and by attending an event where photography and/or videography is taking place:
The Client confirms that they have informed their guests that visual content may be captured during the event.
The Client and participants acknowledge that such content may be processed, stored, and used by the Photographer for legitimate professional purposes, including portfolio presentation, website content, social media, promotional material, and professional self-marketing, unless a written objection has been submitted prior to the event.
Any request to restrict or withdraw consent for promotional usage must be communicated in writing and may be subject to contractual limitations or additional fees where applicable.
Third-Party Venues & Event Locations
Where coverage takes place within private venues, resorts, parks, or managed locations, the Photographer’s rights remain subject to applicable Mauritian law and any valid written authorisations obtained from venue operators.
However, no implied transfer of copyright or usage rights to a venue, organiser, or third party shall occur without a separate written agreement signed by the Photographer.
Governing Law
This policy, and any disputes arising from the use, publication, or ownership of visual content, shall be governed by and interpreted in accordance with the laws of the Republic of Mauritius, without prejudice to the Photographer’s statutory and contractual rights.
