The word photographer may also mean videographer* and vice versa
My make up artist will be at home at 9 a.m , why has the photographer* set his arriving time for 11a.m when the church is at 15 p.m , will he not miss the whole make up process ?
We will document all aspects related to preparation, arrival, and photo sessions in a manner that emphasizes flattering moments, while excluding any unflattering details, such as the initial phases of makeup application. Our coverage includes the setup of your residence and your accessories, as well as a request for the makeup artist to perform retouching towards the end of the makeup process, subject to her availability, to achieve a final look within the allocated time. Additionally, we adhere to a pre-agreed photographer-client plan and will not accommodate any third-party timelines. In the event that the pre-agreed schedule is not adhered to due to extended makeup application by the artist, the overall preparation process may become uncertain, and we shall not be liable for any photos we typically suggest that cannot be captured
On the wedding day will the photographer* be asking us to pose for everything and disturb the normal occurrence to ensure he get nice pictures ?
For indian and muslim wedding we generally have free movement and may indeed ask for some posing without disturbing the event process drastically just to ensure having nice pictures but same wont apply for Catholic wedding as the ceremony officiant do not corporate at all and may even prevent us from moving freely , reducing our chance to have creative content and same will be rather documentary during the whole ceremony if so, as mention in the T&C we wont bare responsibility for that part.
We have a loving animal that we want to be photographe as well as other stuffs valuable to us , will the photographer* take pictures of these ?
We only capture anything related to the bride/groom in the context of their wedding, anything else will be at the discretion of the photographer , going from your pet , to photo on the wall up to bottles intended for the party or other objects that are not on the toast table but not limited to these.
During my exit it is planned that my uncle set fire crackers , but the photographer* does not want to take picture of that moment , why ?
Our operators have strict instructions to only cover things that will ensure their equipment's' integrity as safe as well as their own physical security , in this context anything that goes against this principle wont be covered , equipments may be damaged or our operators may be injured in this process , principle that also applies for lasers , rainy days during which we may stop any capture where our equipment's integrity is at risk. This also applies for the drone as mention in the T&C but not limited to these.
While my fiancer is coming to my house for the 'fleur d'oranger , i was told that the boy side team will go to church , and the girl team may left as well before i get into the car and will only take a part of my exit , why is this ?
We have a pre agreed planning with the cleint in terms of arriving and exit time from the morning up to the reception , in this context where the photographer faces any rush due to client not being in time , we will give the highest priority to the ceremony which incurs being on ceremony site 5mins at least before the bride to set up the camera (Tripod setting up , microphone stand as well as other logistic imperatives for the ceremony) and be prepared for the groom's entrance in respect with the officiant who may not coorperate and request immediate groom entrance even if the operators or relatives are not ready or present , we wont take responsibilities where the client request us to stay until she get into her car and same causes unpreparedness at church.
In the morning we have each a team for each side but then we got only 1 photographer and 1 videographer at some point , did i not pay for them to stay till the end ?
We do hire more operators when same event occurs at the same time at 2 far away location for preparation or when there's safran/geet gawai on 2 side booked by the client but this does only apply for catholic wedding regarding ceremony and reception , we reserve the right to keep only one operator for video and another one for photo at our discretion.
I noticed that the photographer* were asking to people not to be in the way and directing the wedding at some point preventing my guess to move and get their pictures of us from their phone.
As the sole service provider of photo or/and video we encourage the guess to stay at their places so as to avoid any incident as the operators walk along the aisle backward and needs free pathways to get the Bride and groom's entrance from different angles , in this context we allow ourself to request the guess not to be in the way during the whole entance , where same is not respected or where we are ask not to direct these critical moments and where shots are missed , we wont take any responsibility.
I noticed the photographer was not filming us all the time and was alternating between different things , meaning no full song , no full guess side view , will my film be as it happened and in full or chopped like a highlight with background song ?
We deliver full real time video for ceremony and reception where speeches and important moments are kept as they happened , however the agreement set by AJN PRODUCTION MAURITIUS give us the free creative ability to cover what we deem important for the final video , with as only request by the client to cover their wedding day with maybe some little request ,in this context the alter and the speech tables during reception are the only places where we ensure full coverage with an always-on camera ; for the singers , guesses , deco and even dancing these will be film ocasionally in order to deliver a consistant video of not less than 1hr film but also not more than 2hr30 unless given specific request during the booking process which will be at our discretion.
On the wedding day i gave the photographer instructions on how i want him to film but it does not go the way i asked , am the client and i have specific wish regarding my photo/film.
Given that we have our own filming and editing style that may or may not look like other vendors' style , minor request may be taken from the client but in general we keep our internal process as guideline to keep the same quality for which we are book unless where there is a written agreement with add-on set up during booking with a detailed listing.
We had a lot of little animations, game , karaoke , fire work , but we did not get them in full and for some it was really short although we always informed the videographer* together with the guess through the microphone.
We generally cover the most out of your reception but with main focus on what is relevant to our post production and style which mean we wont give you 3 hours of the singer or 1 hour of your animator for obvious equipment and logistic limitations , we rather cover on a highlight basis and at random full intervention out of the whole animation , for example 3 full songs out of 10 , 3 animations out of 10 as same may be occuring at the same time as we are capturing other important elements , or when our staff has a session with the couple or guess or also the staff is resting/eating as mentionned in the T&C. We highly encourage a clear planning and the client going according to it , where the planning is not being followed we will miss things that are being announced at random without us being personally informed. We reserve the right to pick and choose more relavant elements at our discretion if no listing is provided during the booking.
A lot of things were shortened in my film and i want a complete revision to add them back to my video , can the photographer come at home so we rewatch everything together ?
We only provided a 1 time minor change , edit , adjustment and or correction based on a list that the client must send in written through any channel not more than 1 month after delivery in the situation where there's errors during the post production process , no taste and color things will be changed unless a pre agreed add-on fee is added during the booking process. We in no way provide service like coming to your house to watch and critic the film as no budget is allocated for same in our package, we in no way will reedit the film based on what you want , we edit and create content in the way it happened , the fact that we complete delivery imply that the edit made correspond to our standard and more important it correspond to the event as it happened, where the video is deemed imcomplete or something missing we will inform the client and work together on a solution , we do not offer film-production like services but rather a coverage and final video service rather.
Why is there nothing about my guess eating , why cant i see the dinning hall in the video and photo , also i greeted all the guesses one by one but cant find the full video of same ?
WE DON'T FILM PEOPLE EATING AT ALL , this is one of our moral principle as we consider that your guess did not have the chance to give consent to us prior to your event being in their intimacy moment , we will instead film people being served or show the food being served or at worst film a wide view of the eating zone . Guess greeting is captured in a highlight way and at random to ensure a proper coverage of the event at whole.
My song selection was about 30 songs but they were not all used, i want a reediting to add the missing one or the one used at some other point.
We ask for song list but their use remain at our discretion where no guideline is given by client as to where and at what moment to use them prior to editing.
I paid a dj to perform with all its sound system and sound but during the reception he was asked to switch off the laser light by the photographer and am upset that same could not be used .
The use of lasers poses a significant risk of damage to our equipment upon contact with the camera's glass component, even for a brief duration. Therefore, we will request that the DJ turn off the lasers during our recording session. If this request is not honored, we reserve the right to terminate the recording. Should the client insist on using lasers while our equipment is exposed, an advanced indemnity fee not exceeding Rs 150,000 will be imposed. This fee is intended to cover the potential damage to our equipment, which includes two cameras and approximately three video cameras utilized during that time. It is important to note that damage to camera sensors caused by lasers is irreparable, necessitating complete replacement of the affected cameras.
I noticed that the reception dance section of video was quite dark , i dont understand , are the videographer not suppose to light the room to get bright footage for my film.
The DJ is responsible for the aesthetics and atmosphere of the event, darkness has proven to be effective in encouraging guests to dance. As part of this setup, the DJ may turn off all lights to create a cozy ambiance and use lighting effects that can be up to five times brighter than the normal room brightness. This can cause video footage to appear dark due to the camera sensor adjustment to these lighting conditions, depending on the brightness levels and the frequency of the lighting effects. This principle applies for the makeup artist , the priest and other service provider having the expertise that in particular subject which may bypass our ability to cover correctly the event.
We do not accept responsibility for any issues resulting from excessive darkness or noise in the video caused by these lighting conditions. Where feasible and without obligation, we may attempt to add 1 to 2 stops of lighting while respecting the DJ’s or family's request to turn same off when instructed.
I noticed we got the same camera view in my live video and the final delivered video , i paid for 2 different services so why is that ?
We do provide live video and post edited video(final video) , in the situation where both service are being book we reserve the logistic process internal and are not liable for the 'how we work' aspect in this context , to be transparent using 3 camera for live and another 3 camera for post edited video implies a film production team being hired , camera being rented and the ceremony site giving special film production-like facilities like electricity outlets/ tables and permision involving security process linked to the huge amount of variables , instead we use the same 1 to 2 feed to live broadcast and record for post prod editing taking away any of those costly variables which makes it possible for any couple to benefit from a low cost dual services .
Some of my guess were not in my film at all , am unhappy of that.
Without a listing of who not to miss apart from your close relatives , we will do our best to get everyone but may leave a lots of people aside due to variables that are not under our control like guess staying outside , intrusive situation like guess eating which we wont film ect , also situations like guesses not wiling to be filmed but not limited to these.
The film i got ended with people dancing , i dont like it , i expected to see a video of us maybe waving out or gettinfg back to our car , i want same to be change to another moment.
We provide a video coverage and unfortunately not a film production where things can be created/modify/recreated for visual purposes , in this context we will edit your video as it happened and as it ended with respect to our departure time which is 22hr (This may be extented at our discretion), meaning if at the time of end of our service we got people dancing , this is what you wil get in your video in the end , we will of course add a little highlight video with title to end the video but no change in timeline will be done whatsoever unless agreed during booking with clear indication of the wished scenes .
The video sent to us through Youtube was sent weeks ago but still the original film has not been delivered , why is that ?
We consider soft version delivery as being the official delivery , the content sent in private link being absolutely the same as present on the pendrive same may be arrange for afterward delivery but we wont take responsibility where client imposes pendrive delivery bypassing the private-link sent video. Booking our services implies having a tv that will easily give you access to a youtube app to view the same video as what you get when plugging the pendrive. We wil be indulgent helping you to the maximum however.
I wanted the re edited video added to the pen drive received but i was told it would only be sent to cloud.
We unfortunately won't redeliver after reediting except where there is obvious error on ourt side , for the rest same will be added to your online library as same incur cost which are not included in your package.
Its been some months after we got the film and photo and while watching it with relatives/parents they noticed the video feel does not meet what they expected , we contacted the videographer* who told us we wont get the raw footage , i want my footage , what can be done.
The bride and groom being our only client , if after delivery we get no feedback after a month we consider the delivery as received accepted and completed. Also booking a wedding video/photo service provider implies having right on the final photo/video only , we keep full right on raw contents and will delete them 1 month after delivery for logistic and cost storage reason, we do however sell the footage separately but at a cost and only where request is made in the days prior or after the wedding , the storage device must be given by the client .
After i requested some revision the 1st time , i just noticed once again other things i want to remove but i was told i will have a fee to pay for that , is it not the job of the videographer to meet my satisfaction ?
Every single contract includes a 1 time free editing with a one error list sent by the client in written and only applies to post prod errors , no editing will be done on taste and color nor on relatives' opinion or where the film respect our style and process.

Definition and attributes
In the following conditions of contract, “the photographer(s)” shall mean AJN PRODUCTION or, subject to condition 8 below, any photographers appointed by AJN PRODUCTION. “The photographer(s)” shall also mean “the videographer(s)” and “images/photographs/prints” shall mean “videos” where video services are applicable includding aerials(drone). “The Client(s)” shall be those whose name appears in the PHOTO/FILM CONTRACT/QUOTE. If the client(s) arrange for a third party to meet the costs of this contract the contract remains with the client(s). The due performance of the contract is subject to the conditions below. These cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer(s) in writing.
1. Copyright:
The Copyright Designs and Patents Acts assign the copyright of the images to the photographer(s). It is therefore contrary to the Acts, and illegal, to copy, or allow to be copied, by any means photographic, by computer, or internet or otherwise, by any person or machine other than by the photographer(s) or their appointed agents. Commercial and celebration clients receive a limited copyright release in their booking contract for the final work (final video/photo montage); please refer to the terms agreed for your specific shoot, by default the copyright is limited to the photographer only. AJN PROD reserves the rights to keep the raw footage for advertising purposes (Limited to ethical and moral uses) or sell them separetely to the client for exclusive right of use subject to prior agreement with no obligation whatsoever.
2. Display:
By booking with AJN PROD through a downpayment the client(s) hereby allow(s) the photographer(s) to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums and prints, venue and other vendor samples, and other such material, providing that the images are used lawfully and without damage to the client(s) image. An exclusivity fee is applicable for clients who are willing to keep exclusive right on the content’s usage where a charge of Rs3000 will be applicable, this exclusivity fee is limited to section 1 i.e., about copyright, where the client won’t have the right to use the content for other purpose than viewing and sharing with relatives.
3.Storage and security:
Images placed in password-protected galleries/cloud or within the website are not available to the public in the normal course of events, these links if shared to relatives may result to leaks due to possible re shares ability, in this context it is impossible to prevent determined persons from accessing these galleries/cloud. The free cloud service offered by AJN PROD is limited to 1 year only without any warranty whatsoever due to the cloud service company's policy which may change and even be unaccesible , The cloud service being a free service offered with no conditions and as a channel of distribution we highly encourage clients to download their gallery immediately and use the cloud service as a secondary source only, on the other hand we do not guarantee to be able to give you back your content in case it is lost on your devices or on our website after you confirm having access , we highly encourage our clients to have a backup storage of anything sent by AJN PROD following our service to them.
4. License, Coverage and Reproduction:
a)i - The Photographer(s) shall be granted artistic license in relation to the poses photographed and the locations used. The photographer(s) judgment regarding the location, poses and number of photographs taken shall be deemed correct or otherwide agreed in the planning list with required details.
ii - We will do our best to get a detailed hourly planning from the client but if same is not sent we wont take responsibility for missed shots , late arrival due to last minutes planning or any event we were not informed during the booking due to the absence of a written planning . Also as AJN production is offering budget packages we have to cut on some logistics to keep the quality such as sending the same team (Photographer/videographer) to cover Bride and Groom's preparation unless we judged the 2 location to be too far from each other (other cost will apply) , in this context we highly encourage the client to consider about 2 hour difference between Bride's prep and Groom's prep , if same is not respected , once again we wont take any responsibility where shots are missed and where we have to leave the prepation location due to prep planning overlaping on the wedding ceremony planning causing prep/toast and exit to be missed. We do our best to cover in worst conditions like crowded venues ,close tables disposition , wrong table of jonnor vs cake table disposition , deco away from the main room, rainy days or dark venues , in this context having no control on these elements , we wont bare responsibilities where some situation cannot be covered , for difficult weather conditions we may arrange with the client to postpone the photoshoot(other cost will apply). Where a client wish voluntarily to have the wedding photoshoot (Non redeemable option ) on another day other than the said booked date and without prior notice , same will be charge as a normal couple photo session with no price reduction possible.
iii - For Catholic Wedding where the priest generally don't appreciate lateness we will take the ceremony as the main event of the day and interrupt any coverage(preparation/toast/exit) so as to be at least 10min at the church before the official starting time to install our equipment like Audio recording device , camera on a tripod as well as light where the location is not well light , we will take no responsibility where shots has been missed if the planning has not been respected due to either bride or groom caused the lateness (extended makeup , extended prep , longer photo session , key family member being late or other service provider causing the lateness)
b) Photographs taken during the course of the event will be at the discretion of the photographer(s) although every effort will be made to comply with the Client(s) requirements if any.
c) The photographer(s) shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer(s) on leaving somebody out for whatever reason except if a list has been set up or indication about specific personalities was clearly made and effort done to have the person in view (Client side).
d) For bookings at certain venues the photographer(s) movements are sometimes restricted by the officials in charge. The area from which the photographer(s) is able to shoot may not be the photographer(s) choice and the photographer(s) cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting is purely optional and at our discretion based on the clients' or our aprehension regarding poor lighting on location , also same may be restricted or prohibited as well, being of utmost importance we highly recommend that these dispositions are set by the client during our meeting, on the other hand we do bring our own lightings either way without any contract obligation whatsoever, same applies to audio recording for which connection won't be done through the church/reception venu xlr sound system to avoid any possible incident or recording error due to third party connection , we hence will record from either ambiant or from speaker out close recording where any other sound will pick up like traffics , people chatting , shouting with absolutely no control on the outcome and relying on the good dj sound system output and the correct microphone use during speeches at church and reception venue. We will make no important adjustment to lack of sound or lighting where same has been pick up in a poorly light/mic situation due to indroduction of noise to both situation , we take absolutely no responsibility where the recording sound/image goes noisy due to the DJ raising randomly the sound and reduces the lights during dancing especially , we will do our best in both situation trying to deal with the vendors regarding light and sound but limited to their will for coorperatrion . The use of laser by DJ being more and more present during wedding events , we wish to warn our customers that the use of such decorative lights causes severe damage to our equipement , we therefore will ask the dj to turn them off during our recording and may stop our recording if same is not respected , where client does not wish to coorperate and ask us to cover with laser on , an advanced indemnity fee of not more than Rs 150,000 corresponding to our photographers 2 camera plus about 3 video camera used during these moments will be requested to cover the damage equipement that will occur following such wish ( It is to be noted that camera sensors damaged by laser cannot be repaired and the whole camera need to be replaced )
e) The photographing of parts of the event may be restricted or prohibited. Client(s) are strongly advised to check with the appropriate official before signing this contract. The services provided by AJN PRODUCTION may be perform by 3rd parties where needed according to our representative’s availability and the time taken by client to confirm a booking. The use of 3rd party shall not cause a difference in the service quality whatsoever, any anomaly should be referred to our representative if any by the client in not less than 7 days of the event so we can offer a compensation or a re-shooting where applicable.
f) The photographer(s) shall endeavour to capture all the moments throughout the day as they occur. However, because of the fluid nature of events & for logistical reasons, some moments might not be recorded entirely. Also, we may miss some shots where multiple events happening at the same time and/or where no prior notice were made on events that may not necessarily be in context with the final video such as people eating, people enjoying outside, ceremony preparation by the officials before any ceremony, food preparation and serving etc but not limited to these. We do our best to get everything as long as it is not in conflict with the logistics reserved in the package booked by the client.
g) Any alterations/modification to the booking by the client(s) once details have been confirmed and booking fee settled may only be at the discretion of the photographer(s) and in some circumstances (such as the change of date or time) the photographer(s) may be unable to accommodate these alterations due to a conflict of commitments. Under these circumstances, the photographer(s) are not liable to compensate the client(s) in any way whatsoever but to find another date or offer a voucher for future booking in the worst scenario, given that the booking fee is non-refundable.
h) Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Please note that certain colours do not reproduce exactly in print or final edit, we do our best in post-production to bring everything back to its original look.
i) All photographic printing is undertaken within the technical limitations of the process and colour may not be identical over the whole range of colours within a subject. In addition, prints made at different times or in different sizes may be variable in colour balance. (Limited to contracts where a photobook is offered or added to the package)
j) Due to the limitations of computer monitors, it is understood that\ (1) images appear differently according to the specification of each monitor (2) prints will not match images rendered on any particular computer monitor.
k) All print and presentation sizes quoted are approximate and subject to the discretion of the photographer(s).
l) Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer(s) will not be responsible for photographs that are not produced due to technical failure of a limited numbers of raw (up to 10% of the raw library), either at the shooting or processing stage.
m) Where products are made available for use with a personal computer the default operating system shall be Windows 7 home premium edition. Products may not function on other or earlier operating systems.
n) Where products are made available for use on DVD players reasonable steps are taken to ensure compatibility, but DVD discs may not play on all DVD players particularly older models.
o) Where video is made available the delivery format shall be PAL in standard definition on DVD. Compatibility cannot be guaranteed with NTSC or other television formats used outside the UK. High-definition delivery may be available by prior written agreement.
p) We do not offer 4k video quality meaning some 4k TV may wrongly interprete the video as blurry and gives false color , we cant be accountable for video deamed blurry or with false color if same is being viewed on such devices which have different pixel count and may be connected through incompatible cables. A special request may be made to upscale the video with other cost applicable.
q) For every delivery a storage quota is applicable of not more than 16gb corresponding to the average storage for the longest average wedding , in the case where this limit cannot be respected , we reserve the right to compress the video in a non destructive way and not to deliver photo which would be duplicata of same delivered and stored in your personal cloud space offered for 1year by AJN PRODUCTION . If the client wants more storage , same may be added with other cost applicable.
5. Prices:
a) All standard services and optional extras specified on the Booking Form and paid for in full before the event are supplied at the prices ruling on the date of activating the booking through a down payment . Optional extras not paid for in full before the wedding are supplied at the prices ruling at the time of receipt of the order.
b) The client(s) will be liable to pay any additional expenses incurred by the photographer(s) not already included within the contract price. This includes for example fees charged by some venues, and dispatch of products to non-Mauritian addresses, copyright music requested by the client, performers’ fees, entrance fees or any cost not intended in the initial agreement.
6. Payments and Failure to pay on time:
a) The Client shall book as per contract to retain AJN PRODUCTION to perform the services specified in the quote sent during the negociation and info gathering process. A non-refundable deposit of 30% (paid in cash or by online bank transfer) will confirm your booking. The deposit forms part of the total cost of your Package (i.e., it is NOT in addition to the cost of the package) and is deducted when calculating the final balance due.
b) Payment is due in full on the FIRST EVENT DAY unless otherwise agreed in writing or for payments being classified as add ons which will be considered as additional costs . Non-receipt of the full balance, either before or on the day of the last event will be deemed as a cancellation of the contract by the client(s) removing all responsibilities and liabilities upon the digital contents recorded by AJN PRODUCTION , their storage and processing, backup and delivery. AJN PRODUCTION may erase the contents in the case where less than a total of 75% has been settled up to the event day , same will be considered as transport and labour cost. If more than 75% has been settled up to the last event day AJN PRODUCTION reservesd the right to freeze the delivery process and add a charge of 20% of the total contract price where payment is still not settled within 5 days.
c) All additional goods must be paid in full on ordering. This includes extra prints, albums, special editing and rendering of images, high resolution digital files, high-resolution long-term galleries, and any other services ordered after the event.
d) Title to all goods remains with AJN PRODUCTION until paid for in full by the client(s).
7.a) Complaints:
Due to the gigantic volumes of data captured which may go up to 8hours of footages , errors are made during the editing process leaving delivered digital either occasionally unreadable , being unesthetical or having other audio or visual issues at some point during the viewing of the content , we welcome your request for changes through a detailed list to ensure a proper amendment , taste and choices are excluded from what can be categorized as complaints by default particularly where the request includes removing an unwanted guess , reducing the video length or extending same , doing an time alteration to suite your wished ending and anything else that would break our coverage policy . Any complaints about errors made during the editing process leaving delivered digital either unreadable , being unesthetical or having other audio or visual issues must be received in writing within seven days of receipt of products purchased. This includes photographs, discs, albums, frames, videos, and any other special services that have been agreed with as exclusion what can be defined as taste and choices. This also applies for the duration and list of photo , same should reflect reality in terms of volume delivered , for a Catholic wedding one can expect up to 800 Photo , for a civil wedding up to 200 photo depending on the number of locations and what was organised , for an indien wedding one csn expect up to 2000 photo for a 3 to 4 day wedding . During our selection of the best photo lots of those which are blur , wrongly framede or not flatering for the people being in are removed , in the case where client notice missing photo a list should be sent to AJN PRODUCTION at one row so we can explain and recover where possible with high chance there is an issue with same. Complaints made after 7 days will be processed on a sorting principle/basis where the changes may be implemented in off peak seasons with possible extra fee if the wish list is based on taste and personal choice.
b) Editing request are at the discretion of AJN PRODUCTION where same does not meet the Complaint list found in section 7 a) of the contract , also any edit requested by the are delivered by cloud or other equivalent streaming services. Where reediting requires that a bigger space volume is required to keep quality for example , we reserve the right to refuse any request even with charges to put it back on pendrive due to the technical issue of 4gb limit on pendrive to be plyable in fat 32 format on all TV which would require compression and spliting which both would reduce qulity.
8. Force Majeure:
a) The due performance of the contract is subject to alteration or cancellation by the photographer(s) owing to any cause beyond their reasonable control (e.g., conflicting date, sudden illness/injury/victim of crime, flooding).
b) The photographer(s) may contact other photographers in the event that they are not able to attend your booking due to clause 8a). However, it may prove difficult or impossible to find a skilled replacement photographer who can offer the full service at short notice.
c) In the event of cancellation by the photographer(s), or in the unlikely event of total photographic failure (although re-shoots may be arranged if practicable) – the photographer(s) will not be responsible for costs in order to stage re-shoots. The photographer(s) liability shall be limited to a full refund of any deposits and fees paid.
d) If for any reason one of the parties or both are constrained to cancel the booking due to natural causes such as cyclone, flood, government restriction for any reason whatsoever, the booking fee will be kept idle until another date is agreed. However, in the case the client insists to cancel the booking all cost except the booking fee shall be refunded at least 28 days after the request or upon mutual consensus. Also, where climatic conditions cause a postponement of the event partially, a percentage agreed by both parties is to be paid, the rest should then be paid on the final covered day (reception), for any partial postponement AJN PRODUCTION cannot guarantee its availability and if no agreement is found, it shall be considered as a partial service coverage and both parties may agree on a final percentage to pay.
e) If for climatic conditions AJN PRODUCTION cannot provide some specific services or where random timing delaying causes lateness due to client not being on time (As per planning given in written or oral to our staff services like cine style video (gimbal use), drone services or photoshoot, this should not be considered as a breach of contract and an arrangement shall be done by both parties to consider for example a post wedding photoshoot session and/or drone coverage where we keep the right to offer or not a video coverage for same , however the client will be liable for any extra cost this may create as a result of transport logistics and staff .
f) If the client decides to postpone the event date, AJN PRODUCTION being unable to guarantee its availability, we may send a 3rd party to cover the event without the need for any AJN PRODUCTION representative to be there. Also where booking was made less than 6month from the main event AJN PRODUCTION may send third parties with any of its representative are there considering that we choose the best freelancer to cover our events. Also as we work on region based , we may send 3rd Party with no prior notice to do the coverage , taking into consideration that we do our best to get 3rd parties with the same level of expertise as AJN production's style and expertise.
g) If for any reason third parties cannot provide specific products such as photobook , canvas ect , AJN PRODUCTION will only be liable to the refund of the amount equal to the product value at the time of the agreement after a specific time frame referenced in section 9g.
9. Liability for Digital Files and Products and creative freedom:
a) The negatives and raw files shall remain the property of the photographer(s) and all deliveries and raw are erased about 1 month after being sent of delivered in hand to client . Any request done outside of this timeframe will be limited to esthetic changes onto the already delivered video/photo from the client source (pendrive), where error has been detected before the 1 month limit (Which is neither of taste and color nature) , we will happily undertake a recheck to meet our standard and redeliver by cloud only. After final delivery and after 1 month from the latest request inside the acceptable feedback period negatives/raw will be deleted as well as any bulky content already used as project for final video version , in this context it is of the client responsibility to ensure all deliveries are backup on their side , we take no responsibilities in the case of theft , fire or any sort of lost where client may revert back asking for a second delivery , we do offer to store backup of raw and final deliveries at a cost if asked during booking or suggest same at our discretion without any liabilities/obligations, in general and without any request from the client deletion will occur where back up service cannot be achieve due to the costly process of storing such bulky contents after final delivery ( Raw footage , raw aerials , raw photo, final edited photo , final edited video but not limited to those).
b) Should negatives and raw files be lost, damaged or destroyed before the delivery date the photographer(s) liability shall not be oblige to refund of fees paid, or refund for any goods already supplied or capable of supply at a quality deemed acceptable by the photographer. No refund will be due for any negatives or digital files lost, damaged, or destroyed after 1 months from the date of delivery of the final work.
c) No supportive content, photo, video sent by the client or 3rd party will be used in the final video or Album, we reserve the right to accept such contents at our discretion where quality match our software configuration only (resolution, frame rate etc.)
d) All orders for pre-paid products should be placed with the photographer(s) before the end of a 2- month period starting at the event date unless otherwise agreed in writing. The photographer(s) will not be liable for failure to produce any orders placed after this time.
e) All deliverable images as per contract will have standard image editing (including: light skin retouch, light and colour adjustments). Any extra edits requested by the client will cost the client Rs100 per image if accepted by the Photographer. extra image adjustments include (change the size of the body or parts of the body, replace parts of the body from another image, change the colour of parts of the body, extra skin retouch, replace or swap background). It is also understood that unless hair and makeup is included in the contract, Photographer is not responsible to fix hair or skin, or makeup problems.
f) Any pre-paid product credits (e.g., for albums and prints) not utilized by the clients within 1year of the date of the wedding will lapse without value unless otherwise agreed in writing. Any product supplied will be at the sole discretion of the photographer(s) and forwarded by Mail to the last known address of the clients or by cloud using Mega or Drive.
g) AJN PRODUCTION being limited to digitals, we do rely on third parties for services such as photobook, canvas, pen drive boxes, pen drive and packaging. We may be in partnership with a specific supplier due to special prices which may not reflect the market price. By extension the terms and conditions of the supplier applies to our customers namely the time taken, color accuracy limitations, number of changes (limited to one for errors and wrong photo selection and disposition order , the delay and any issue that may affect the supply of such products. AJN PRODUCTION will only limit its responsibilities to a refund of such order at its price at the time of contract agreement or advice the client to wait, Supply delay of more than 6 month will automatically activate a refund process or a discount on future agreements.
h) Your wedding video/photo is governed by the concept of creativity , that same creativity that encouraged you to book with us through social media and/or portfolio sample (Highlight video/Highlight photo), in this context we work with as main goal the visual appealing of your video/photo together with our own artistic style which means full "creative freedom" on the ground of filming and editing except where a written request during the booking process is made with clear indication of a given style where other fees may apply accordingly , in this respect we do not make revisions based on taste (changing scenes, changing music, adding phone footage , extend video , change intro or outro , adding photo to video but not limited to these.....) except curing a defect (misspelling a title, damaged file, unrendered effect, flashing black images...) anything that goes in the taste and color parameter is at the discretion of AJN PRODUCTION and has an hourly editing fee applied and a processing period which will follow the queuing principle .
i) We do not precise the number of camera or angles used , this remain at the discretion of AJN Production where 1,2, 3 or even 4 camera angle may be used as per the situation and requirement based on the location . Where explicit request are made to provide more camera which means more operator a separate quote with options about camara will be sent to the client for example to provide 2 teams for boy and girl preparation before wedding (Catholic wedding) and/or both side indian wedding coverage. It is understood that we work with a minimum of 2 and not more that 3 operators ( 1 photographer + 1 Videographer and an optional assistant at our discretion) on a wedding set for standard package advertised on our page and portfolio.
10. Cancellation Fees:
a) If the Client(s) should have to cancel a booking the down payment of not more than 30% paid for booking is kept as cancellation fee to cover any other booking lost as a result to the said finalized booking.
b) If cancellation occurs on the event day itself the client will be liable to cover any cost incurred by AJN PRODUCTION in terms of transport, equipment rental and food.
c) Where the photographer(s) are able to rebook the date with an equivalent booking, then the cancellation fee may be reduced at the photographer(s) discretion or we may offer a service equivalent to the amount paid in case it is more than the down payment amount.
11. Placing an Order and delivery period:
a) Any alterations to orders must be notified either by phone or email and confirmed in writing (sent by Email) within three working days of the order being placed. The photographer(s) will not be held liable for any costs incurred due to alterations to the order made by the client after this time.
b) Allow 2 to 12 weeks for delivery of photos/video. Where you choose to design a photo album through AJN PROD, or where you are to receive a video, you will be notified of the estimated completion date on a case-by-case basis , however during peak season where we get high demand and lots of post production work as a result this delivery period may be extended to 4 to 6 months regarding video only , client may ask for delivery of a short or highlight passing 8 weeks for free (Express Cloud Delivery).
c) The photographer(s) must be notified either by telephone or email and confirmed in writing (sent by Mail) within three working days of the client(s) being in receipt of their order in the case of error, shortage or damage as mistakes cannot be rectified after this period.
d) Due to the nature of the product the photographer(s) are unable to give exchanges or refunds. This does not affect your statutory rights.
12. Privacy:
AJN PROD may store your data on a private internal database. This data will not be made available to outside companies or individuals. Should you wish to have your data removed from the database, please advise in writing and retain your confirmation.
13. Governing Law:
Any contract made between the photographer(s) and the client(s) shall be in all respects be governed by and construed in accordance with Mauritian Law and the parties hereto submit to jurisdiction of the Mauritius courts.
14. Insurance:
The Client(s) are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation.
15. On the day:
a) The photographer is the only authorized photographer for the day. Other professional photographers are permitted whether official or otherwise, working for pay or otherwise (e.g., separately employed by friends or relations, contracted by magazines or newspapers), unless it is specified in writing before the day. We shoot mostly candid photo and video with some rare interuption or posing during the religious wedding ceremony , in this context we do not interfere with whats in the view in realtion to the ongoing ceremony like flowers , bottles of water or sny object use in this respect , however this may conflict with the final edit where we sometimes have to cut or remove these objects without any obligation but for visual benefit and hence loose in quality on the final photo. We encourage a depersonlised setup all the way to reduce the need for post prod objects removal.
b) The photographer is contracted to shoot all photographs relating to the event and no other person is permitted to shoot images for sale or as gifts unless agreed in writing before the day. This includes all attendees (except for their own personal non-commercial use) and other vendor. Also the photographer reserves the right to ask your guess not to be in the way, any faillure to cooperate may ruine scenes for which we may not be taken as responsible .
c) Video may compromise the quality and breadth of your still’s photography.
d) An inconsiderate attendee can wreck the record of your event and we will speak with the client where ever possible. Coverage may be cancelled without warning at the discretion of the photographer if the photographer feels threatened or has reason to believe that equipment may be damaged.
e) We consider by default a meal allowance for the staff deducted from your total service price , in this context , Each photographer will be provided a full guest meal for any type of event lasting longer than 5 hours. If no meal is provided or the meal does not mean the said condition (Where we are given standard staff food and refused full guess meal/drinks access ) the photographer(s) reserves the right to go off-site for a meal for about 1 hour , an updated invoice for food may be sent to the client at the discretion of AJN PRODUCTION.
f) We reserve the right to shoot some shorts ( reel) documenting the day and our shooting style for commercial use with respect to clients intimacy in using non personal shots as part of the day task , client who want their wedding to be private ( service provider and guess ) should inform us prior to the event day so remove any discount or special priviledge to their package and reajust the price ( Price for services we offer for free - Paid Aerial service price Rs 3500 , paid highlight video option Rs 4500 , paid dynamic coverage with multi camera simulteneously Rs 8500) , doing BTS and reels alows us to be known and increase our visibility as well as absorb any cost we do not charge the client for. We count on the clients understanding regarding the need of every event service provider to do so . A second photographer and assistants or a BTS operator may attend small, large or complex events. You will be informed prior to the event of the total staff number.
g) We offer full day video and photo coverage , this does not means real time uncut video recording ,due to storage limitation or power autonomy limitation and more importantly for estheticism of the final video we reserves the right not to film or photographe repeating things during ceremonies so as to get the main aspect of the event with freedom to film everything going on in front and around , for indian and muslim wedding where there may be about 50 to 500 guess we may not film or photographe each of them unless specified in the contracts with a list of pre-defined names not to miss . Also system like safran where about 100ish of guesses come to apply safran we may not film and photograph each of them one by one filming and photograph will be done in a symbolic way with random guess but without missing main people like relatives already indicated by the client prior to the event, these condition apply to the whole wedding days.
h) Photoshoot session ,and aerial being part of the package , in case of impossibility to offer those services on the wedding day , same can be postponed to another day according to both parties availability , for drone we may use stock footage to illustrate the location of the event without it to be considered a breach in the event that the impossibility has been confirmed by the client ( weather condition or due to air space restriction).
i) We work on proportional basis for non-listed contract like engagement video , birthday video or other same type of booking due to the unusual aspect of such request where the price may be arranged as per the clients budget going from Rs3500 for a one location coverage and basic ceremony booking up to rs 18000 for a multi-location coverage including drone and multi camera where we expect to get much contents , in this context AJN PRODUCTION will apply a proportionality editing style basis where a budget edited video (less than Rs5000) may not last more than 10 to 20 min even we have filmed everything on location as long as no major occurence is missing (Cake cutting if any, planned speeches, Ring exchange, general establishing shots and general guess appearance ) we reserve the right not to use/edit/deliver all the footage unless the client want to upgrade.
16 . Whats included and excluded by default in wedding package and how we work in general :
By default and without the client request we cover from preparation up to the last occurance as long as its before 22:00 p.m with add ons at Rs2000(photo/video) per hour , anything going from relative chating , the environment around and in the location , the different set up like deco , lighting , welcoming board will be covered with no limitation on the creativity ground. During the ceremony we allow ourself to be in every angles to get the ceremony from different point of view with guess , deco , the aisle , the main building as well as aerial view where possible with drone which by default is in all package but subject to weather condition and geo-restriction. There is no photo number limits , any guess can ask for a photo and this goes from the start to the beginning of the event and same are delivered to the client who then take the responsibility to share them. For photoshooting as long as same is done in the event vicinity we have no restriction to provide little photo session where needed to the client as well as the relatives as long as it does not disturb the main event which are the prep ,ceremonies , wedding and reception.
Exclusions : It is understood that we work with as objective the esthetism as well as the flow , in this context WE DO NOT FILM PEOPLE EATING PER TABLE OR FOOD BEING PREPARED AS WELL AS FULL RECEPTION DANCING , AJN Production will only film quickly and without being intrusive to people eating , we will film people taking the food or the servers bringing food and drink to the different table to illustrate the open buffet time as well as people enjoying the moment. For dancing we will film different song style full and skip repeating style like 1 to 2 slow out of 8 played by the DJ at random.
17. Services to 3rd parties - Any contract may be it wedding or corporate and attributed to AJN PRODUCTION by a 3rd party (Photographer/videographer/wedding planner / dj and any other srvice provider) who acts as a bridge intermediary between AJN PRODUCTION and the final client will be charge only for execution and editing based on the 3rd party guidance only , these guidance may not reflect the final client wishes and guidance due to information leakages that may occur or misinformation from the 3rd party during the meetings with AJN PRODUCTION , we do our best to get all the info before the execution of the contract but has observe a lack of interest from the 3rd parties during the last years , in this context AJN PRODUCTION will bear no responsibilities regarding requests or information that have not been communicated by the 3rd party like filming style , specific moment not to include or cover as main or B-Roll. AJN PRODUCTION will consider the 3rd party as the main client which exclude being present during booking or discussion about planning and payments , which exclude having to deal directly with the final client unless for minor info on the day or for location validation and last minutes reconfirmation , this prevent us from charging 100% of the normal rate to the 3rd party ( e.g a Rs 25000 video may be charge at only rs Rs 8000(Lead Coverage only) Rs 15000(Lead/editing/delivery)/Rs4500(Second shooter coverage only) , Rs 3500 Drone service allowing the 3rd party to have a margin of more than 50% ) at this cost we wont take part in any discussion or meeting before, during and after the event, the leading role will be left to the 3rd party who will continuously ast as an intermediary. In the case where the 3rd party cannot assume the leading role of problem solving and decision making and where he wishes to transfer the responsibility on AJN PRODUCTION , he will have to pay full cost and refund any issue relating to the final product where coverage has not been done as per final client wish due to misinformation by the 3rd party upon AJN PRODUCTION. In this same context AJN PRODUCTION takes all the responsibilities for 3rd party we hire for execution will photographer/videographer ect.
ii Services to companies - Any contract executed for corporate purpose may it be stock contents , marketing video ect will be charge at maximum rate including the execution , the exact time frame indicated in the request , at the only exact location indicated in the request , the exact number of people in the request as well as 2 to 3 changes upon delivery , other cost like transport , changes regarding the place , time , number of people will be applied accordingly. BTS contents will be taken for advertising purpose without the need for permission well as some covered content with the permission of the client. At the end of the coverage an updated quote will be sent to the client and must be accepted in not less than a week so as to enable the delivery.
AJN PROD holds its office at Camp Levieux rose hill for any request of information, and a website is also available to the public http://www.mauristocks.com We consider that you have read and understood the above and agree to abide by the terms of agreement set out. That you understand that the terms of this agreement cannot be change unless agreed by AJN PROD in writing. That you realize that this contract becomes effective immediately and agree that deposit is not refundable and cancellation rates will apply in the case of any cancellation by the client.
By default, signing and paying the booking fee make all these terms and conditions applicable, a copy either hardcopy or softcopy will be automatically sent to every client or a link will appear on the quotation and invoice .
